Terms of Service

These Terms of Service ("Terms") govern your access to and use of findqia.com and related services (the "Service"), operated by Jesslyn Tantomo, trading as Qia (ABN 25 516 818 574) ("Qia," "we," "us," or "our"), based in Melbourne, Victoria, Australia.
Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.
1. About the Service
Qia is a software service that generates personalised Feng Shui "readings." You provide information about a property (including a floor plan), its surroundings, and optionally the birth details of the people who live or work there; Qia uses classical Feng Shui frameworks together with AI to produce a written reading with suggestions, which you can view and download as a PDF. The Service is for personal, informational, and lifestyle purposes (see Section 6). The Service is currently provided free of charge; if we introduce paid features, we will update these Terms first.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements. The Service is not directed at children.
3. Your account
To use the Service you must create an account (by email and password, or via Google sign-in). You agree to provide accurate information and keep it current, to keep your credentials confidential, and you are responsible for all activity under your account. Notify us promptly at hello@findqia.com if you suspect unauthorised use. Do not impersonate others or choose a name that infringes rights or is offensive.
4. How readings work
When you request a reading, you submit inputs (property details, floor plan, intentions, and optional birth and life-context details). We process these — including via third-party AI and PDF providers (Section 9) — to generate and store your reading. You can regenerate, download, or delete readings from your account. Readings reflect one methodological approach to Feng Shui and are generated automatically; they are not reviewed by a human practitioner unless we expressly say so.
5. AI-generated content and its limitations
Readings are produced using an artificial-intelligence model operated by a third party (Google / Gemini). AI is probabilistic — it generates text from patterns, not verified facts or professional judgment. You acknowledge that:
- readings may contain errors, omissions, misinterpretations, or content that conflicts with classical sources;
- the AI may express incorrect information in a confident tone;
- results may differ between generations even for identical inputs;
- the AI has none of the judgment, experience, or context of a trained Feng Shui practitioner; and
- readings should be treated as a starting point for reflection, not authoritative guidance.
We do not warrant the accuracy, completeness, or reliability of any reading, and we may change, update, or discontinue our AI provider at any time.
6. Nature of the Service — not professional advice
Qia is an informational and lifestyle service. Nothing provided through the Service — including any reading, suggestion, BaZi/Kua analysis, or other output — constitutes or should be relied on as:
- professional Feng Shui consultation;
- architectural, structural, engineering, interior-design, or construction advice;
- medical, psychological, or mental-health advice;
- financial, investment, legal, or career advice; or
- a prediction of future events, or divination with any predictive authority.
Readings present traditional Feng Shui and Chinese-metaphysical frameworks for general interest and personal reflection only. We do not guarantee any outcome — including any improvement in health, wealth, relationships, career, luck, or wellbeing — from using the Service or following any suggestion.
7. Changes you make to your property
The Service may suggest changes to layout, orientation, use of space, placement, colour, or other elements. You agree that:
- any physical change you make to a property is made entirely at your own risk and discretion;
- before any structural, electrical, plumbing, or other significant work, you will engage a licensed professional, and you will comply with all building codes, safety regulations, and laws (which the Service does not assess); and
- we are not responsible for any damage, loss, cost, injury, or dissatisfaction resulting from changes you choose to make.
8. Birth details and metaphysical content
Where you provide birth details for BaZi, Kua, or zodiac analysis, you acknowledge that such content is cultural and informational only, is not a prediction of, and does not determine or influence, any person's actual health, relationships, finances, or life. Do not make significant life decisions based on it. Interpretations vary between schools and practitioners; Qia presents one approach. If any content causes you distress, please stop using the Service and seek support from a qualified professional.
9. Third-party services
The Service relies on third parties, including our hosting/database/authentication and storage provider (Supabase / Lovable Cloud), our AI provider (Google / Gemini), our PDF provider (PDFShift), and Google sign-in. We don't control these services, can't guarantee their availability, and are not responsible for their acts or omissions. Your use of features that depend on them is also subject to their terms and privacy policies.
10. Your content; licence to us
You retain ownership of the inputs and files you provide (including floor plans, photos, notes, and birth details) ("Your Content"). You grant us a limited, non-exclusive, worldwide licence to host, process, transmit to our service providers, and display Your Content solely to operate and provide the Service to you (including generating, storing, and letting you download your readings). You represent and warrant that:
- you have the right to provide Your Content and that it does not infringe any third party's rights or any law; and
- where Your Content includes another person's personal information (for example a household member's birth details), you are entitled to provide it and have obtained any necessary consent (see our Privacy Policy).
You must not upload unlawful, infringing, harmful, or malicious content.
11. Our intellectual property
The Service itself — including its software, design, text, branding, the "Qia" name and logo, and the structure and presentation of readings — is owned by Qia or its licensors and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal use in accordance with these Terms. You may use your own readings (including the PDF you download) for your personal purposes. You must not copy, resell, reverse-engineer, scrape, or create derivative works from the Service without our written permission.
12. Acceptable use
You agree not to:
- break any law or infringe anyone's rights;
- reverse-engineer, scrape, or use automated means to access or extract data from the Service without authorisation;
- upload malware or attempt to disrupt or gain unauthorised access to the Service; or
- resell or commercially exploit the Service or readings without permission.
13. Disclaimers
To the maximum extent permitted by law, and subject to Section 14 (Australian Consumer Law), the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free.
14. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded. If you are a consumer under the ACL, our goods and services come with guarantees that cannot be excluded.
Where we are able to limit our liability for a failure to comply with a consumer guarantee (other than certain guarantees relating to title, undisturbed possession, or undisclosed securities), our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.
15. Limitation of liability
Subject to Section 14, to the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, data, goodwill, or property, arising from or in connection with the Service or any reading; and
- our total aggregate liability arising out of or relating to the Service is limited to the greater of AUD $100 or the amount you paid us for the Service in the 12 months before the claim.
This includes, without limitation, any loss or harm resulting from: reliance on a reading or AI output; changes you make to a property; decisions made in reliance on BaZi or other content; and inaccuracies or errors in any output.
16. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Qia and its operator from claims, liabilities, damages, and reasonable costs arising from your breach of these Terms, your misuse of the Service, Your Content, or actions you take based on a reading.
17. Suspension and termination
We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. You may stop using the Service and delete your account at any time. On termination, your right to use the Service ends; sections that by their nature should survive (including Sections 5–8, 10, 11, and 13–16) survive.
18. Changes to the Service and these Terms
We may modify or discontinue features at any time. We may update these Terms; for material changes we will give reasonable notice (for example by email or in-app) before they take effect and update the date above. Continuing to use the Service after changes take effect means you accept the updated Terms; if you don't agree, stop using the Service.
19. Governing law and disputes
These Terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that place, without limiting any rights you have to bring proceedings in your country of residence where the law requires. We'll always try to resolve issues informally first — please contact us before taking any formal action.
20. General
If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor (e.g., in a sale of the business). These Terms, with our Privacy Policy, are the entire agreement between us about the Service.
